Frequently asked questions about property insurance

Do I as a landlord absolutely need buildings insurance?

It is not required by law, but in practice it is indispensable: every lender demands it as a condition of the mortgage, and without it you carry the full risk of fire, escape of water and storm damage yourself. For a landlord it is the foundation of all cover.

What do I need property owner’s liability insurance for?

As the owner your liability is unlimited if someone comes to harm on or beside your land, through black ice, a loose roof tile or a broken step. For a let property no private liability policy will respond. Property owner’s liability closes exactly that gap, usually for only a few euros a month.

Who takes on the insurance when a property is sold?

An existing buildings policy passes to the buyer automatically on sale (section 95 of the German Insurance Contract Act). The buyer then has a special right of termination and can cancel or restructure the contract within one month of the land registry entry, a good moment to have both the cover and the premium reviewed.

Are natural hazards included in buildings insurance?

No, and this is the most common misunderstanding. Flooding, heavy rain, sewage backflow and landslip are not covered automatically; they have to be added as a natural hazards module. In Saxony, with its history of flooding, that module is strongly recommended.

Is landlord legal expenses cover worth it for a single flat?

Yes, particularly then. A single possession claim can quickly run to several thousand euros in solicitor, court and enforcement costs and drag on for more than a year. With only one or two let properties, such costs can rarely be absorbed out of the rent.

What does insurance advice cost at ESTAYA?
