Flöha is a large district town (Große Kreisstadt) in the Landkreis Mittelsachsen with a good 10,000 inhabitants, situated at the confluence of the rivers Flöha and Zschopau, around 14 kilometres east of Chemnitz. Who pays the estate agent's commission when buying a property in Flöha?
Whoever instructs the estate agent owes the commission. When a private individual buys a flat or a detached house, an additional rule applies: if the agent charges both sides, the fee must be equal on both sides, otherwise both contracts are void (Section 656c German Civil Code, BGB).
